duplicate content of your site in your site won’t give you a penalty, but duplicate content from other websites will most likely give you a penalty

i do hope that google is indeed smart enough to figure out when duplicate penalty is inadvertent or merely a result of the site’s structure, and not an attempt to game the system.

Another aspect of the duplicate content topic: People tend to overreact the duplicate content issue, just think about the news sites. There are tons of them out there and they use the same content that they get from AP and other news agencies. Still, these news sites don’t get any penalty.
